Wrongful death claims in Arizona are governed by A.R.S. § 12-612. This statute identifies the individuals that may pursue damages as the result of the wrongful death of a family member. In Arizona, the following parties (known as “wrongful death beneficiaries”) have a right to pursue damages for the loss of a life:


  • The parents of a deceased child
  • A surviving spouse
  • Any child of the deceased individual
  • The decedent’s estate.


No one else in Arizona has the legal claim to pursue a wrongful death claim based upon the passing of an individual.


A wrongful death claim may be pursued if an incident meets the following requirements:


  • There is a death of a human being, and
  • The death was caused by wrongful conduct of another (person or entity), and
  • The wrongful death beneficiaries have sustained damages (emotional, monetary, etc.).


 A wrongful death beneficiary may pursue damages for the following losses:


  • Monetary compensation to compensate for the loss of love and affection (this could include companionship, protection, care, instruction, guidance, advice, etc.)
  • Loss of income and financial support
